1. SELLER IDENTIFICATION
These General Terms and Conditions of Sale are those of SAMMODE SA, a public limited company with share capital of €65,240, whose registered office is located at 24 rue dues Amandiers – 75020 Paris – France, registered with the Paris Trade and Companies Registry under number 572 201 846.

2. APPLICATION AND ACCEPTANCE OF THE GENERAL TERMS AND CONDITIONS OF SALE
The purchase of products offered on the www.studiosammodev2.test website (hereinafter the “Site”) is subject to the Site’s general terms and conditions of sale (“Terms and Conditions”). Sammode products from its Studio range (“Product(s)”) are exclusively intended for sale to end consumers, whether individuals or legal entities, to the exclusion of all resellers or intermediaries acting on behalf of resellers. Consequently, the “Customer” affirms that it is acting as an end consumer and that it does not intend to resell Sammode products for commercial purposes.
SAMMODE reserves the right to modify these General Terms and Conditions of Sale at any time by publishing a new version on the Site. The General Terms and Conditions of Sale applicable are those in force on the Site on the date the order is placed by the Customer; it being specified that any order for a Product offered on the Site implies the Customer’s full and complete acceptance of the General Terms and Conditions of Sale in force at the time the order is placed.
3. SUBJECT
The purpose of these General Terms and Conditions of Sale is to define the conditions under which Products are sold by Sammode to the Customer. They regulate the various stages of the sale: from the placing of the order by the Customer to the delivery of the Product to the Customer.
4. PRODUCTS
The Products offered for sale by SAMMODE are those appearing on the Site on the day of consultation by the Customer. Each Product will be the subject of a description sheet which will contain: the price, the photograph, the dimensions and colors available, as well as the particular characteristics. Minor differences between a product and its photograph may exist, depending in particular on the resolution and color definition of the user’s screen.
5. PRICE
Prices are indicated in euros, inclusive of all taxes and excluding delivery charges; it being specified that the value-added tax is that in force in mainland France on the day the order is validated.
The prices applied are those communicated on the Site and confirmed to the Customer when the order is validated.
Delivery costs are communicated to the Customer on the order summary page before the order is validated, and are inclusive of all taxes. These costs are payable by the Customer and are invoiced in addition to the sale price of the Products.
The Products ordered remain the property of SAMMODE until full payment has been received by SAMMODE.
The transfer of the risks of loss and deterioration of the Products will take place after delivery to the address indicated at the time of the order. We reserve the right to modify our prices at any time, but we undertake to apply the prices indicated on the Site at the time of your order.
We inform you that in the event of the display of an erroneous or obviously derisory price (low price), for whatever reason (computer bug, manual error, technical error, etc.), the order – even if validated by us – will be cancelled, and we will inform you of this as soon as possible. You will then be able, if you wish, to place your order again at the correct price.
6. PRODUCT ORDERING AND PAYMENT
6.1 Placing an order
The Customer completes his order in the following 5 steps
Step 1: the Customer selects the chosen Products and adds them to his/her basket after having selected the type of fastening, the color and the desired size. The basket at the top right of the screen informs the Customer that the selections have been taken into account, indicating the number of Products it contains.
Step 2: The customer checks the contents of the basket by clicking on “order” to access the order summary. The Customer can then modify the order (quantity). The total amount of the order, including VAT, distinguishing between the price of the Products, the eco-contribution and the delivery charges, is then indicated in the summary.
Step 3: Once the order has been checked and, if necessary, modified, the Customer validates the basket in order to finalize the order by clicking again on “order”.
If the customer has an advantage code, reserved for the best customers, he/she must enter it in the space provided in order to benefit from it.
Step 4: Customer enters delivery and billing details With the exception of the date of birth, additional address and delivery details, all fields are required to finalize the order; it should be noted that unless otherwise specified by the Customer, the billing address will automatically be the same as the delivery address.
If the Customer has already placed an order on the Site, he/she will have a customer account. In this case, he/she will only identify himself/herself with his/her e-mail address and password. The customer then checks all the information and clicks on “validate” to continue with the order.
Step 5: Entering bank details The Customer will then access the secure payment screen of Sammode’s partner as specified in article 6.3 below.
Payment is made online by credit card or Pay Pal.
The Customer must enter his/her bank card number, its date of validity and the 3 numbers of the visual cryptogram on the back of the card, it being specified that in the case of payment by American Express card, the Customer must enter 4 digits.
If payment is accepted, the Customer will be redirected to an order confirmation screen on the Site.
If payment fails, the Customer will have up to 3 attempts to re-enter his/her bank details. After the 3rd refusal, the Customer will be redirected to a screen on the Site indicating that payment has been refused. The Customer will then be invited to contact Sammode’s customer service department to find out the reasons for the refusal and to work together to find a solution to finalize the Customer’s order.
6.2 Order confirmation
Upon acceptance of the Customer’s payment, the Customer will receive an email summarizing all the items ordered, the billing address and the delivery address. The Customer will receive a second e-mail from Sammode with order confirmation and estimated delivery date within a maximum of 4 working days.
The validation of the order by the Customer and the order confirmation sent to the Customer by e-mail by SAMMODE following acceptance of payment constitute the conclusion of a sales contract between the Parties and acceptance of the General Sales Conditions.
The Customer will have access to his invoice in his customer space following shipment of his order.
SAMMODE reserves the right not to validate the order in the event of :
- Abnormal or abusive complaints,
- abnormal orders with regard to quantities ordered,
- abnormal or abusive exchanges and returns,
- existing dispute(s) with the Customer.
The Site’s customer service department is available to answer any questions the Customer may have concerning his/her order. Customer service
6.3 Payment
The price of the Products purchased is payable in full on the day the order is placed by the Customer. Payment is made online by the following methods (Carte Bleue, Visa, Eurocard/Mastercard, American Express, Pay Pal) when the order is validated by the Customer.
The request for authorization to debit the card is made at the time the order is validated on the Site, except in the event of server unavailability. SAMMODE reserves the right to proceed with a new direct debit authorization request in the event that the first request is unsuccessful due to server unavailability.
In the event of non-payment, an erroneous address or any other problem with the Customer’s account, SAMMODE reserves the right to block the Customer’s order until the problem has been resolved.
In the event of fraudulent use of a credit card on the Site, the Customer is invited to contact SAMMODE at the following number: 01 43 14 41 45, Monday to Friday, 10am to 12:30pm and 1:30pm to 5:30pm, or by e-mail at the following address: [email protected].
Transactions carried out on the Site are secured by the payment system of Sammode’s partner, Adyen, recognized by the main players in the financial world. This solution has been developed so that you can make your payments in an ergonomic, user-friendly environment, with optimum security and respect for privacy. Adyen e-Commerce is the payment solution adopted by several thousand e-commerce sites. You’ll recognize these sites by the words Secure payment by Adyen, which appear on the payment page.
Adyen checks that the connection with the customer’s browser is secure before sending the payment form to the banking institution that will carry out the financial transaction.
As Adyen is a technical service provider, it does not handle order disputes, which are handled directly by Sammode as described above, or by the customer’s bank if necessary.
6.4 Order archiving
The order confirmation is recorded on SAMMODE’s registers, which are themselves kept on a reliable and durable medium. The Customer accepts that the order confirmation is considered as proof of the contractual relations between the Parties.
7. DELIVERY
SAMMODE will deliver orders accompanied by a delivery note within a maximum period of :
- Seven (7) working days for delivery of products in stock to metropolitan France (products indicated as “Shipped within 3 days”)
- Fifteen (15) working days for delivery of out-of-stock products to Metropolitan France (products indicated as “dispatched within 10 days”).
For countries outside mainland France, products will be shipped within 10 days.
If the delivery time is exceeded, without justification by a case of force majeure, the Customer may request the cancellation of the sale and obtain a refund of the sums paid for the sale within a maximum period of 30 (thirty) days.
For orders outside France, when the parcel intended for export reaches its destination, it will be the responsibility of the recipient to pay any taxes or customs duties applicable in the country of destination. Local authorities can provide useful information.
8. RECEIPT OF ORDER – COMPLAINTS – RETURNS
It is the customer’s responsibility to check the conformity of the Products received at the time of delivery. Any anomaly concerning the delivery such as :
- damaged package,
- missing products,
- damaged products,
- products that do not conform to the order, must be notified within the legal time limits following receipt of the order. This notification will be sent to the Site’s customer service department either :
- by registered mail, by writing to the following address: SAMMODE, Service eshop, 24 rue des Amandiers, 75020 Paris.
- by e-mail to [email protected]. After this period, and except for hidden defects, no claim will be accepted by SAMMODE, the Products then being deemed to be in conformity.
- For any return of a non-conforming Product, the Customer must comply with the following procedure:
- the customer must enclose the returns form, duly completed and printed using the returns form which will be sent on request to [email protected]. No returns will be accepted without the duly completed returns form.
- Products must be returned in their original packaging, with their label and any accessories, in perfect condition to SAMMODE

- The risks and costs of return are the sole responsibility of the Customer.
- When the non-conformity has been noted, SAMMODE will offer the Customer: reimbursement of the price of the order (price of the Products and delivery costs) as well as the cost of returning the non-conforming Product, at the latest within thirty (30) days from the date of sending of the notification of the confirmation of the non-conformity by the Site’s customer service.
In the event of a refund, SAMMODE will reimburse all products returned in conformity, as well as the shipping costs incurred, with the exception of taxes and customs duties paid by the customer upon delivery.
Cash on delivery returns are not accepted. Upon receipt of a non-conforming item, SAMMODE will reimburse the cost of postal returns in accordance with the price list (Colissimo delivery without registered mail) posted by La Poste on March 1st of the current year. The customer must send proof of the return costs incurred to Customer Service by e-mail. In the event of abnormal or abusive complaints, SAMMODE may refuse to serve a subsequent order.
9. RIGHT OF WITHDRAWAL
The Customer has a period of fifteen (15) working days from the date of receipt of the order to return the Products ordered, without justification or penalty.
For all returns under the right of withdrawal, the procedure below must be followed in full:
- The customer must enclose the returns form, completed and printed out beforehand, which will be sent on request to [email protected]. Products must be returned in their original packaging, with their label and any accessories, in perfect condition to SAMMODE

Subject to the aforementioned conditions, SAMMODE will reimburse the Customer for the amount of the order including VAT (price of the Product and shipping costs) excluding return shipping costs. The Customer’s bank account will be credited with said amount within thirty (30) days of receipt of the Products by SAMMODE.
10. PERSONAL DATA
SAMMODE collects a certain amount of information necessary to process orders.
This data is not only necessary for SAMMODE to process the Customer’s order, but also to provide the Customer with information on the SAMMODE brand, on the Site or to allow the Customer to benefit from SAMMODE’s commercial offers, if the Customer accepts this when validating his or her order.
The information is strictly confidential and is marked with an asterisk (*) when it is necessary for SAMMODE and/or its service providers to manage the Customer’s order.
Following any injunction from the legal authorities or in order to defend its rights or those of its employees, customers or any other person, SAMMODE may communicate this data to legally authorized organizations and authorities.
SAMMODE undertakes to take all necessary precautions to ensure the security of its files and the protection of its computer system, and in particular to prevent the Customer’s personal information from being distorted, damaged or accessed by unauthorized third parties.
In accordance with the French Data Protection Act of January 6, 1978, as amended by the Act of August 6, 2004, customers have the right to access, rectify, modify and delete data concerning them.
The site is registered with the Commission Nationale de l’Informatique et des Libertés (CNIL) under no. 1919577.

11. COOKIES
In order to process the Customer’s order, and in order to better understand the Customer’s needs and personalize the services offered on the Site, SAMMODE uses cookies. A cookie is a computer file stored on the hard disk of the Customer’s computer, the purpose of which is to indicate that the Customer has visited the Site.
Cookies memorize the time spent on the Site and the contents of the customer’s shopping cart. Once disconnected from the Site, this information is stored for 90 (ninety) days before being permanently deleted.
Customers may prevent cookies from being stored by configuring their Internet browser. In this case, he/she will not be able to personalize the service offered on the Site.
12. LIMITATION OF LIABILITY
Placing an order on the Site implies knowledge and acceptance of the procedures in force on the Internet network, in particular with regard to technical performance, response times, connection times, queries or transfers of information, risks of interruption, risks of contamination by viruses circulating on the network and, in general, all risks associated with the use of the Internet network.
SAMMODE can therefore in no way be held responsible for any direct or indirect damage resulting from misuse or incidents related to the use of the computer, access to the Internet, maintenance or malfunction of servers, telephone lines or any other technical connection, as the Customer’s connection to the Site is made under his/her sole responsibility.
13. FORCE MAJEURE
SAMMODE shall not be liable for the total or partial non-performance of its obligations under the order placed by the Customer, if such non-performance is caused by an event constituting force majeure as defined by positive law.
In such a case, SAMMODE will inform the Customer of the occurrence of such an event within 3 (three) clear days following its occurrence, by e-mail.
After a period of 1 (one) month, and in the event that the event constituting a case of force majeure persists, the order will be cancelled and, if applicable, SAMMODE will reimburse the credit card used to place the order within a maximum period of 30 (thirty) days.
14. APPLICABLE LAW
Should any of the terms of these General Terms and Conditions of Sale be declared null and void, illegal or unenforceable by a court decision, the other provisions of the General Terms and Conditions of Sale shall remain in force.
The General Terms and Conditions of Sale are executed and interpreted in accordance with French law. In the event of a dispute, the customer shall first contact SAMMODE to obtain an amicable solution. Failing agreement, the Courts of common law shall have exclusive jurisdiction.
